General Sideshow Customer Service Question, not SW related

About two months ago I ordered one of the Predator Statues. It was shipped via UPS promptly, but then while tracking it came up on UPS' site that the item had been "damaged in transport" and that UPS was notifying the shipper. I have called pretty much once a week and they keep telling me they are working on it. Nothing has happened. Anyone had this happen before. I finally today just asked for a refund. They keep telling me they will call or email me with a status and they don't. I know it is not their fault, but still.
